PalPal does not protect seller property

I recently sold a vintage electronics item on Ebay and used PayPal as the payment handler( Audio Research SP3A-1). Because the item was vintage, it was sold without any warranty, as is and without returns accepted. Listing clearly stated that function was not guaranteed and that the item had not been powered up in over 2 years. The buyer was able to reverse the charges based on the fact that the item was not as described. He stated that the Tone control did not work and that there was a slight hum. If this was true these are minor items in a vintage unit but again the unit was sold as is, without warranty, without returns.

In addition the buyer claimed that he never received 10 very rare and valuable vintage vacuum tubes that were shipped with the unit. The UPS store that professionally packed the unit faxed verification to Paypal that the tubes had been packed/included with the unit. Paypal never took this into consideration and this should have been a red flag that the buyer was not credible.

I truly feel that Paypal did not represent me (the fee payer) in the transaction. At no time did Paypal adequately explain the status the claim. Their answer was that if the item is "not as described" that "90%" of the time the money will be refunded to the buyer. This is absolutely absurd. Any buyer can claim this and THEY WILL WIN. I am still waiting to receive the item from Fed Ex but the buyer has stated that there were no tubes. I am concerned that parts may have been switched or taken from the unit as well as replacement parts are very valuable.

I would like the full amount of the transaction awarded to me in addition to any other possible damages. I will ship the unit to Paypal if they agree. I am interested in a class action lawsuit as well. Please help me. Paypal is a horrible company to deal with.

Did you have a question?

Look- you AGREED to the terms that Paypal offered when you decided to do business with them. You're not going to get anywhere with a class action suit.

Furthermore - where did you get the idea that Paypal would "represent" you? :confused:

Paypal only has a duty to themselves (and their shareholders). The seller protections are quite limited and do not cover SNAD complaints. If you are going to deal with ebay/paypal you need to learn how the system works. Ebay's own paypal, policy, and seller's forums are better than here. It's more of a business issue than a legal one.
