paper didn't print my ad

my husband and i own a nightclub in a small town in west virginia. a few months ago we had a male revue perform at our club. we took out an ad with the local paper and the night was a huge sucess. recently we had the revue back and decided to take out another ad. we took out the same ad we had before, paid for it, and was told everything looked fine and they would print it. they did not print our ad and the night of the revue we lost a lot of money. only a handful of people showed up. we inquired about them not printing our ad and they said they could not print it because of the subject matter. they had the ad for two weeks and never bothered to tell us they weren't going to print it. we could have taken it somewhere else. they still have not given us a refund either. do i have any rights in this matter?

Newspaper add

This is not a cut and dry thing, but you probably do have a case against them. You probably had a right to rely on them because they did print the add a few months ago. Although they probably did have the right to refuse to print the add, they did have ample time to inform you of that. Since you had a success with the previous revue, you can prove damages. If you can show that you actually could have taken the add somewhere else, then you should have a good case.
