Paper work for Voided Marriage License

What is the name of your state (only U.S. law)? South Carolina, Kerhaw County

In 1994, I married a man whom finding out a year later his first wife shows up for a divorce. I went to an attorney who told me our marriage was not valid and if I wanted to continue to live with him to keep all my affairs separate from his, (banking, filing taxes and financial) which I have done. He walked out on me September 1, 2016 and since that time trying to get him out of my life, he has been using the marriage license to cause me financial harm. I was informed that I need to have the license VOIDED. I filed the "Complaint" (Action to Find Marriage Void) with the Exhibits of his final Divorce papers and our Marriage License along with the Cover sheet needed. Papers were filed and stamped by the clerk of court, I then had him served the file documents....received my "Affidavit of Service" waited the 30 days for him to reply to the complaint...no reply has been served as of today. I went on May 8th to request a hearing...filled out form needed with the attached Affidavit of Service. I was informed by the Clerk of Court there is some form missing and they can't give me a hearing date but won't tell me what they need in order to submit to receive a hearing date.

I am self-representing myself since I can not afford a lawyer...I need to know what other form is needed for the Clerk of Court so I can get a hearing date and get this over and done with before he does me any more damage.

How is he using the marriage license to cause you financial harm? I cannot help you about whatever other form it is you need, but I might be able to offer some suggestions on protecting yourself financially.

I owe property in my own name "ONLY"....the "Sole" contractual owner. I had given him a lease to said property...just found out in August 2016 that he was over $8000.00 dollars behind in payments. The seller of said property was getting ready to foreclose on land but after speaking with the seller he agreed to work things out with me to clear up the arrears...I sent the man I was living with a notice to vacate said premises, (revoking lease) and that was when he went to Probate got the copy of the Marriage License took it to Magistrate claiming we are married. I have been working on getting the land monies straight but now having an issue to get him removed from land.

I think that you need an attorney. Perhaps you could find a local attorney who would just charge you for an hour of their time to give you advice on what you need to do. The guy married you knowing that he was already married, and he was willing to lie about it to avoid being evicted from your property. He is a sleezeball and you need to be shot of him ASAP.

I think that you need an attorney. Perhaps you could find a local attorney who would just charge you for an hour of their time to give you advice on what you need to do. The guy married you knowing that he was already married, and he was willing to lie about it to avoid being evicted from your property. He is a sleezeball and you need to be shot of him ASAP.
As I stated before, I have been put in such a financial stress there is no money to obtain a lawyer. I live on Social Security Disability...only spending money on bills...including this big debt he created.....very little spend on food and any necessities. So, for this very reason I am forced to do this on my own with no help from the court. When asking the Clerk of Court this morning concerning about not receiving a court date I was informed that some form was missing...asking them what form, their response is "We can not give any legal advice", I didn't ask for legal advice I asked what form is needed, I thought these people working at the courts are suppose to be "public servants"....not just advocate's for lawyers! My health is deteriorating and I am wanting to get my affairs in order so my Daughter who has POA along with executrix over my Will....will NOT have to deal with any of this...Lord knows her grief will be hard enough.

You don't really have the makings of a successful pro per litigant. Most are either hyper-polite and grateful for anything anyone does for them or are motivated maniacs that spend all their waking time learning about the law in regards to the matter.

I suggest that you either start over and follow some guidebook for state-specific filings (found in your local law library) or develop a thick skin and get over any court-derived victimhood. Litigation is difficult and emotionally draining. If you are going to get snippy over your theory over what the court clerk is supposed to do, you're going to have a bad time all the way through your suit.

My advice is to drop things or to get an attorney.
