What is the name of your state (only U.S. law)? CA
I have a 3 1/2 year old daughter with my ex. We have been in court probably a total of 60 times since our daughter was born, all petitions my ex has filed with the courts. Most recently, my ex filed for sole legal and physical custody because he made allegations of physical and sexual abuse against some of the other children at our daughter's daycare. Since the birth of our daughter, my ex has accused my family members, friends, and even a prior daycare provider of misconduct.
When preparing for my response, I went through all of the previous petitions my ex filed, and pulled out any that included sexual or physical abuse allegations, which were several. I also had documentation from a pediatrician that my ex took our daughter to, claiming that she contracted herpes from me, one of my family members or daycare. The doctor noted that my ex was demanding that someone file a CPS complaint, which the doctor refused because our daughter had no signs of abuse. The doctor noted that my ex was asked to leave, which made him incredibly unhappy.
Anyways...When we appeared in court our mediatiors told my ex that he clearly has an unnatural obsession with sexual molestaion based on his history of allegations. Due to this, they recommended a psychiatric evaluation on my ex and possibly a custody evaluation. He got pretty irate with the mediators. So, they have set us up for a long cause hearing in January.
Since our last court date in June, our daughter has been repeating some disturbing things that she says daddy has told her to say. She's been repeating that "Daddy says you're a bad mommy" " I like daddy more than you" " I want to live with my daddy" " I want (step mom's name) to be my mommy" And, just the other night she told me that "Daddy says you let bad things happen to me".
Also, she told me that Daddy has told her to not kiss or hug me, her stepfather, my parents, or my husband's parents.
On top of all this, I'm expecting my second child any day now, which my daughter says her daddy has told her that her little sister is "dead in mommy's tummy" and that her little sister is "retarded".
I've been documenting everything, but I'm getting really concerned on how this is making our daughter feel. I don't know how to respond to her when she says these things. I was referred to a child psychologist, but she is hesitant to deal with a child as young as my daughter. My theory is that my ex is teaching her to say these thing to use against me in court in January.
I tried to speak to my ex about this, which didn't go so well. His response was that "i am going to get whats coming to me"
Can I file to get into court sooner? Or do I have to wait until the long cause hearing in January?
