My son was caught shoplifting (first offense) cold medicine from Walmart (He has a substance abuse problem); total value was about $16. We went to court and he was placed in a diversion program.
I received a letter from a law firm representing Wal-Mart to recover civil damages of $50. However, the letter states: 1) The file has not been personally evaluated by an attorney; and 2) The letter is a settlement offer in order to settle POTENTIAL claims Walmart may have against us, arising from this incident, for a lesser amount before this matter proceeds any further within our office. They reference statutes 604.14 & 540.18.
As the value of what was stole was less than $20, should we hold off and wait to see if Wal-mart will go any further? Or should we just pay the $50 (my son will be actually paying whatever it ends up costing).
Just so you know when I got the call from Walmart about my son, I was the one who requested the police be called and he be charged. He has been through several treatment programs and as a parent they have taught us to quit enabling and to let our son deal with the consequences of his actions.
