Ok my dad signed an EA with his employer. I have had a business for 6 months that sells products that are similar to what he designs at work. While exhibiting at a trade show, I conceived what I believe is a patentable invention. I documented the conception and had it witnessed properly. Considering that I still live at home and that the invention relates to my dad's work, does his employer have rights to my patent? If I didn't live at home would that change things?

The answer will probably depend on what your dad's agreement with his company is. However, even if you are not covered by the agreement, if the company sees what you are producing, and finds that it is closely related to your dad's work, they could accuse your dad of giving you the information (either directly or indirectly) and try and sue you anyway.

If you are going to be making any money with this invention, you should talk with an attorney who can review ALL of the facts of your situation and advise you accordingly.
