Hi,
Please advice me in dealing the below accident.

I was about to go out for lunch from my office. I get in my car and started my car after check all the spots and put the reverse gear and checked back and confirmed no car is backing and started reversing my car. I was pulling my car from parking lot in zero speed. After pulling the car for quarter, i turned to my left and checked left side whether any car in coming into the parking lot. That time, the car behind me put his reverse gear and moved very fast (may be in good speed that will cause more damage).

He hit my car directly and my car was totalled and no damage to his car. That guy is telling that it's also ur fault since you were also moving your car and refused to take that it was his fault. I am having only liability insurance. That guy insurance company is telling, they can pay only 50% of the car value since I was also moving back. But I told them that it was not my mistake since he moved his vehicle very fast(he was in hurry to go somewhere) and no time for me to look him.

Now what are the ways that I can negotiate with tehm and get my car value full. Please advice me.

I don't know, there's a CA cop around here somewhere who might be able to tell you :)

I'm going to have to suggest you contact a lawyer for help here though. With your English not being the greatest, and it's pretty difficult to get money out of someone else's insurance company to begin with (even if you deserve it!), your chances aren't great on your own. Maybe there's a local legal aid association that can help you out?

Was your car moving at all when it was hit? I don't know much about the laws in CA but it's possible that if you were moving even a little, that would make part of the responsibility yours.
