What is the name of your state (only U.S. law)? vt..I work 5 days a week from 5pm to 12pm. 1/2 hour is deducted off pay automatically for break,(I do NOT punch out for breaks). I lost my benefits since my employer claims I am part time and not full time. He is basing this on what hours I am paid for and not how long I am at work. Since he is deducting my break time it puts my hours below the full time level. Is that how it works? ty Faith

As long as you are actually taking the break and not working through the break, it sounds fine to me. You do not have to be paid for any break of at least 30 minutes, and your hours are based on the time you are actually working, not the entire time from the start of your day to the end, if there is a break in the middle. And the insurance policy will define eligibility based on the number of hours actually worked. If you don't meet the definition of eligible employee, then they can't cover you.
