Partition Action In Minnesota

What is the name of your state (only U.S. law)? Minnesota

My mother died about a month and a half ago. About eight years ago she did a Quit Claim Deed for her house to all of us three children. All three of us own the home in Joint Tenancy. One of my sisters and I want to sell the house, but our other sister is quite difficult to deal with. Can we prepare the home for sale and list it with a real estate agent with her and just pay her her portion at the time of the closing? Of does she need to sign some documents at the time we agree to use a specific real estate agent? Also, if she refuses to sell, I understand that a Partition Action might be in order. An attorney quoted me a figure of about $3,000.00 for this action. What else should I be considering to resolve the issue? If we spend our own money to prepare the home for sale, is there a way to recoup those costs at the time of the sale?

An agent with a lick of sense is not going to take a listing unless all the owners sign the contract. And, even if you find an agent without a lick of sense, you aren't going to close without the other sister's signature on the line that is dotted.

Figure out what it will take to get the other sister to agree to the sale or what it will take for her to sell her interest to you. Otherwise, plan on partition.
