I HAVE A BAD SITUATION I AM DEALING WITH. MY PARTNER HAS REPLACED ME IN HIS LIFE AND HAD BETRAYED ME FOR A YEAR. WE BOUGHT A TOWNHOME TOGETHER AND HE WANTS TO REMAIN LIVING IN IT WITH ME. I FEEL THAT SINCE HE ENDED THE RELATIONSHIP THAT HE NEEDS TO MOVE. HE WANTS ME TO REFINANCE OR SELL, I REFUSED TO SELL. HE HAD A DEADBOLT PUT ON HIS BEDROOM DOOR SUPPOSEDLY AT THE ADVICE OF AN ATTORNEY, I HAD BEEN BREAKING THE DOOR OPEN TO CHECK HIS COMOUTER. ANYWAY, WE HAVE A SECOND I ALONE WOULD NOT QUALIFY. I CHANGED THE LOCKS TO KEEP HIM OUT AND HE BUSTED IN THE DOOR, THE ENTIRE FRAME OF THE DOOR COLLAPSED. I WANT TO KNOOW IF THERE IS ANYTHING I CAN DO FOR MYSELF. IT HAS BECOME A HATEFUL SITUATION WITH LOTS OF BITTER FEELINGS. WE MADE A COMMITTMENT TO STICK TOGETHER AND HE BAILED. I THOUGHT THAT GAY PEOPLE WERE STUPID FOR WNTING TO GET MARRIED. WELL NOW I THINK I UNDERSTAND WHY THEY DO.

I feel your pain, friend, but you can't make someone stay in love with you once they decide to leave.

As long as his name is on the deed to the place, he has a right to live there (even with his new boyfriend if he wants!). The only way you can keep him out of the house is if you have grounds for and can obtain a restraining order that specifies he may not live in the house.

If you do get such an order, he can then turn around and sue you to partition the house by sale. The court would order the sale of the house and split the proceeds between you two 'in a fair and equitable manner.' So, if you can't refinance, you'll have to sell eventaully. If you can't get hte order and don't want to sell, you'll have to find a way to keep living with the guy who dumped you.

Het couples request a temporary marital home order as part of filing for legal separation or divorce. Too bad you don't live in Vermont!
