My daughter was involved in an accident where she was passed on the right as she was turning right onto a small side street. The police did not issue a citation at the accident, but sent all information to the Law Director. The law director determined the other guy was at fault, and he was issued a citation for improper passing on the right. His insurance Co (STATE FARM) is telling me now that they are investigating the accident and that they are "standing by their client" "because he is the one that pays the premiums". Can the insurance company ignore the police report in determining who was at fault?? Are they above the law? Can they refuse to pay to fix my car even though he was the one at fault? I only have liability on my car, and my insurance co, can not do anything about this.

Can the insurance company ignore the police report in determining who was at fault?? Yes. They are not bound by the police report. Remember, that the police weren't there, either.
Are they above the law? No. But what law are you referring to, anyway?

I only have liability on my car, and my insurance co, can not do anything about this.
Unfortunately, since you don't have the coverage, they feel there is no reason to get involved.
