Past Employer Cost Me Job...Now What?

I was recently denied a job due to a negative comment made by a past employer regarding my personal character. I had applied for a position that required a background investigation, which involved interviewing employers from the last 10 years. One of the employers I had worked for 9 years ago was interviewed by the background investigator to whom they made a slanderous statement regarding my character. I had voluntary resigned from this employer, because I felt it was in my best interest (I did not agree with some of the practices of my coworkers). I guess that did not go over well with them. Well, to make a long story short, I obtained a report of the background investigation and found that this employer had stated that I was arrogant, rude, and thoughtless, and that he only recommended me for hire WITH reservation. He went on to state that I had been disciplined and counseled on numerous occasions, but the investigator was unable to locate any reports or evidence of this, because it never happened, and if it did, a report would have been made, because that is company policy. It was interesting to see that out of the 15+ employers that the background investigator interviewed, this was the only one who said anything negative. In fact, the other employers said the exact opposite and recommended me for hire WITHOUT reservation. Based on the one negative comment, I was told that I would not be eligible for hire.

Do I have a case, since I have what this past employer said in writing? Does it make any difference that he is the only employer who made negative remarks?

By the way, the employer is in CA, but I now reside in MI. Does this make a difference?

You do not have a case, regardless of whether it was in writing or not, and your state does not make a difference.

An employer is permitted to give his honest opinion whether the employee agrees with it or not. If it is his opinion that you were rude, arrogant etc., he is allowed to say that.

Most employers would not allow one negative reservation to turn the tide but if this one did, that is their perogative.
