I have a question on patent infringments. I have a copy of a patent that someone has for a technique, I guess that would make it a Process Patent. I am making the same type item, only I am using a technique that I have gotten from copyrighted material to create mine. The person that has the patent is claiming that I am infringing on their patent, not knowing what my process is. They have threatened to sue me and are constantly harassing me about this. Since I am using a different process, and useing copyrighted material with permission to create my own designs, can I legally create and sell my own designs using my process?
I am in Tennessee and the person with the patent is in Florida.
