What is the name of your state? NY

>> I have a client I designed a website for to sell her product. She has a patent for her product and was selling off of someone else's website located in Texas. The guy who owned the website in texas sold her product took the money and never shipped orders. My client has corrected the issues with the customers and has changed the name of the product to clear a "Bad Name". She now has her own website she is selling her product off of and has tried to get the website located in texas to take down the pages on his site that has her product. Even though the products have two different names they are the exact same pictures used on his and her websites. He can not fulfill orders because it is her product. When you search on the search engines for her product both websites come up but thier prices aren't the same. I tried to order from his website and I did not get no response. She has asked him repeatedly to take down the site with her products and he has refused. Is there anything that can be done as it is affecting her business with misrepresentation of her products? She has patents for her products and would like to know if there is anything that can be done since they live in different states.
