Patent on Marketing technique... help me hhaha

Alright, Firstly I would like to say , I LOVE this forum, great help I can see.. maybe I can help others, but I would like to get this little situation taken care of..

I have a advertising//marketing technique, but I have looked and there is a patent pending for a company that does it, Can I still practice this technique? Or am I at fault and liable for sueing?..

I might want to patent it, but i see the company is already doing it.

I also looked more. I Am in the U.S. and there is yet ANOTHER company that does the same things.. the same non-traditional advertising, but they are in AUSTRALIA.. and thier patent and everything is established.. But im in the U.s. so im not sure..

How Can i do this without being sued?
