from texas i am a single mother and ready to give birth to a child whose biological father is a mexican citizen living in mexico. i became pregnant in mexico and then returned to the united states . i am a us citizen. after several months of not hearing from the biological father he has contacted me to say he wants the child half of the time. can you please tell me what his legal rights are.

I beleive they would be the same rights as an American citizen. If you're planning to apply for Child Support, then the caseworker assigned to you, (in YOUR county) will help you further. He will have to file a motion in the court where the child resides. If or when you go to court for visitation, make absolutely sure you know the laws pertaining to visitation in other countries. You can ask your attorney, (and I strongly advise you to have one) or the judge about what could be done to prevent him from not returning the child back to you from Mexico. He's not a U. S. citizen, I doubt if he has very many rights in our courts.

If he refuses to pay support, what can be done to him if he stays in Mexico?

Likewise, if he fails to return the child to you, what can be done?

It's hard enough to get a child returned across STATE lines, let alone international borders.

I would be very afraid to let my child leave the country.
