My landlord applied my deposit to a month's rent when I was going to move, without asking me first and then I did not move. She now tells me that I have to repay the deposit after I had told her way before she did that that I was not being responsible for anything in this apartment due to the water issues and flooding, and so many other un-repaired severe matters. Can she make me repay the deposit? Is this legal?

Instead of thinking of it as paying the deposit again, think of it as paying the rent on that month you missed. You did fail to pay rent that month, didn't you?
