What is the name of your state? California
I have a 2 1/2 year old and do not have child support. The father (active drug dealer/addict) has been uninvolved in our lives but may soon file for custody- so I've heard. He needs to prove paternity first, since no father is listed on the birth certificate. I make good money, own a home, etc. (but due to bills and debt have nothing at the end of the month). He travels from music festival to festival selling ethnic jewelry (and drugs!). It's all under the table. He has another kid he only pays $125 month child support (every other weekend visits, last I heard). Say he was granted supervised visitation every other weekend - is there any chance I would actually have to pay HIM child support!!!???

I believe you already posted this before, however, what makes you think he'll get primary custody? On top of that, what makes you think you'd have to give HIM child support? Take a deep breath accept the fact that he IS the father, file for CS yourself and see what can be done about drug testing him as a stipulation of visitation, if he does indeed want to see the child.

Thanks for replying. There is no way he could get more than visitation/weekend custody, and with his lifestyle I don't think he'd want more than that. I just had heard that the parent who makes more money pays child support to the other. Maybe this is only in the case of primary custody? I do not want to file for custody, or do anything to provide him contact with his child. I feel a flaky, violent, inconsistent, drug dealer daddy will hurt the child more than no biological daddy. I figure if he gets his life together enough to stop doing drugs for a day and go to court, the "legal route", then maybe he's really ready to try to be a father. Any more replies/advice would be appreciated.

OP asked if she would have to pay child support if the BF was granted SUPERVISED visitation. And the answer would be no. Supervised visitation means that his visitation time would be on the dollar of either the state child protection agency or the OP herself - he would have no overhead involved to feed/clothe the child or provide sleeping quarters and such.
