pay reduction?

My husband has changed jobs recently and his last check from the previous employer was mailed to the house, when he opened it he noticed his pay was $2.75 less an hour then his normal pay was, is this legal for an employer to reduce your pay on your last check because you went to a better company? :confused:

Not unless the employee is given advance notice of the pay reduction before working any hours at the lesser rate.

Has your husband called the employer and asked for an explanation? It's possible that this is an honest mistake. I suggest he check that out before contacting WI's Department of Workforce Development and filing a complaint.

Also, he should check the employee handbook as well; while I disagree with the practice there are companies out there which will lower the final week's pay to minimum wage in certain circumstances.

The reason I tell you to check the handbook is that as Beth points out, it is necessary that an employee be given advance notice of any pay reductions. If they say in the handbook that in x circumstances the final week's pay will be at minimum wage, that MIGHT count as advance notice. But if there is nothing in the handbook and they didn't give him any other notice, then they CANNOT reduce his wages for that last check even if they claim company policy.
