I have an adult son who has taken a second job with BAM. When he was hired, he filled out all the payroll information, but the management had issues with his direct deposit. Thay on said there was an issue with his routing number. He then confirmed the routing number with me and the bank and gave it to the management, They tried a second time and said it still did not work. He then went number by number over with it with management and the payroll people still did not get it entered correctly.
He then learned that the manager decided to create a debit account in his name with Bank of America to accept his paychecks. This was done without his consent and the bank is charging him fees for setting up the account, for withdrawing the money from the account and said he will be charged if he closes the account. Is this legal?? How can someone take his pay and route it to an account he did not authorize? Isn't that fraud? When I have done payroll in the past, if there was a problem with direct deposit, we would cut a hard check for the employee until the problem could be resolved. If anyone has any advice on the next step to take, I would appreciate the assistance. Our state of residence is KentuckyWhat is the name of your state (only U.S. law)?
