Paycheck stolen, manager at fault, thief is employee

I was fired from RadioShack the day after Christmas because of a dispute with my manager over a personal day. I never received my last 2 paychecks. I assumed that they would be mailed to my house as, as most employers don't want you coming back to the office. I never received the checks, and called my former manager on January 15th to inquire as to their whereabouts. He said "They were here, but I can't find them now." I asked if he could have them re-issued. He said "I can call payroll and have them put a stop payment on them, re-issue them and send them out to you." I accepted and hung up.

A month went by, and still no checks, so February 10th, I called Payroll myself to find out the scoop. I was told that the checks were never re-issued, and that 1 of them was cashed on February 1st, a full 2 weeks after the manager told me he'd have them re-issued. I was told that they would have to request the cashed check from the bank, and then send it to me after they received it, so I could verify that I didn't cash it ( I know I didn't cash it, they are making me jump through hoops) then they'd send me a form to fill out and have notorized so they could have loss prevention do an investigation, and re-issue my check.

I talked to payroll again today, and the cashed check is on it's way to my house, apparently someone forged my name, and wrote Pay To: and their name. I will find out who it was in the next day or so, but I'm already convinced it was an employee of the store. I believe this because all of the employees checks were kept in the same place, not secured in envelopes, under a counter and accessable to all of the employees.

Also, during this whole debacle, I was attempting to contact the District Manager to ask for his help, I called his office 4 times and his assitant always told me he was out of the office. I left messages every time, and never received a call back. I talked to the corporate office today, and as it turns out the district manager is the one who is supposed to handle these stolen check situations. He's been dodging me this whole time.

I'm going to press charges against the casher of the check. My question is, can I sue the person who cashed the check? Can I sue my manager for not sending me my checks, not having them re-issued, and making them available to theives? And can I sue RadioShack for their check holding policy?

I've been totally hosed by these people, and I want to make them pay, what should I do?
