I owe ACE Cash Express $285 on a payday loan. They attempted to debit my checking account and it was rejected NSF. I have promised to pay in full in 2 weeks. The debt is 2 months old. I was threatened with bad check charges. I live in Ohio and the collector stated Ohio prosecutes?? for payday loan NSFs?? After reading this board there are several threads stating that as long as the is no attempt to defraud they can't since this is a breach of contract. Money that was owed 2 weeks from inception, etc. Does anyone know if Ohio does prosecute for defaulted payday loans? I'll have this paid in 2 weeks and I also paid $75 last week to get it down to $285.
Please advise..

What a crock. The collector is just applying pressure to scare you into paying. While they can TRY to go after you using the 'bad check' attack, its not likely they will.

For what, passing bad checks ??

Misdemeanor: Up to 6 months in jail, $1,000 fine, or both. Felon: Up to 5 years, $2,500 fine, or both.
You didn't pass a 'bad check', you had the bad judgment to go to a payday loan place - they are a black hole and a trap.

The jails sure would be full if they did prosecute for defaulting on payday loans... If they tell you that again ask them to put that in writing and mail it to you.
