Hello,from punkin43612 n ohio
please help! I need advice..

I recieved a cash advance from a payday loan store, but i found out a few days after I got the loan that my account was closed.I didn't know. My account had a huge overdraft, which i had paid prior to getting my cash advance, which brought my account to zero dollars.I didn't bother to check with the bank until after i got my loan. I was about to put some money in the bank. That's when i found out it was closed! Anyway,I didn't pay the loan on time, and now it's 33 days past due. Now the loan people(not the one's at the local branch i went too) have called me at home and at my job telling me I better get myself a lawyer. They were very nasty and rude and threating. They made it seem like i would be arrested any moment for writing a bad check and be in front of a judge in days.If this was a scare tactic,It worked quite well!!!
I did not intend to write a check on a closed account.I honestly didn't know it was closed. I would like to know what i can expect to happen.I tried to make arrangements with these people, but they aren't hearing it.They are heck bent on litigation.I have loans out at other places, all have worked with me and are pleased i'm paying. I'm paid twice a month and i really can't afford a lawyer. The total due is $312.00. I've never been in trouble with the law before. Should i keep attempting to pay something on this loan,at the local branch i went too?
sorry if this is long i'm new to the forum!
thank you.

It's quite common for these people to use scare tactics. More than anything, they just want their money back. The best thing to do is talk with them and setup some kind of repayment plan. Most likely, they'll want you to take out another loan, or rollover your old one.

They will most likely take you to small claims court. If you do not go, they will obtain a default judgement against you, and can then pursue wage garnishment procedures with the court. If you do go, you will have the opportunity to present your side to the judge and let him decide what should happen. It isn't as scary as it sounds.
