I received a cell phone # for a out of state car dealer (through a friend of mines) who claimed he can purchase vehicles from actual Audi auction that Audi dealers purchase there cars. We met a few times but spoke mostly over the phone for over 6 months discussing prices of certain models. Finally i decided on which model i wanted and decided to go to the bank to find out what kind of loan i can get. This is the first vehicle i ever purchased through a bank so i wasn't familiar with the process. With the problems with our economy and my average credit rating, i was told that i would only be approved for 66% of the full amount of the car i was looking for. My fiance and i make more than enough to handle the monthly payments for 100% but our credit ratings were average. The same dealer explained to me that he has friends who worked in Chase and in the credit union (which were the banks i wanted to use to finance my vehicle). Long story short... he used a another dealership to approve my loan for the full amount of the vehicle. I am not sure how he did it... but he explain to me that a car dealership can approve a loan... especially if a car is on sale (or something like that). Anyway, the same dealer came by my job to bring me the paperwork needed for the bank to cut the check for the vehicle. He brought me a:
an out of state bill of sale from a a car dealership in GA (which he signed);
and he told me to contact my car insurance company and have me add the new vehicle to the policy and bring the new insurance policy (with his bill of sale) to the bank.
The bank accepted that information and cut a check for the vehicle. I was originally approved for $27,000 now after whatever he did... i was approved for $36,000. This was in OCT/NOV. I have been paying monthly on this $36,000 loan since then.
Now, on the same day, he explained that he can get me the newer model to my vehicle (from an '06 model audi to a '07) but all we would need to do is bring the paper work from the newer model vehicle to the bank and do an exchange of collateral (or something like that). Just in case... i asked the bank if there is such a thing and they said yes. Mind you, I never saw the '06 model audi in person(except for the pictures he emailed me from the auction)
Now, i have been in communication with this dealer for almost a year where i trusted him. A few weeks after the transaction, he claimed that my newer "07" (which i only saw photos for..." would be delivered but we received a nasty snow storm that weekend. Then after that, he had an operation on his appendix or something in the hospital while his cell phone got disconnected. He called me with a pre-paid phone and now my suspicions rose through the roof. My contact to reach this person was only through telephone. I was in denial hoping that i wasn't a victim in a Madorf type scam for this vehicle. Especially since i spoke to him almost every other day. Each time i spoke to him, he would reassure me that the car would be delivered. Now in January (i know 3 or 4 months and no car) my phone received calls from him about 3 or 5 times a week... now reduced to once a week or less. He claimed to call me from a hospital (all private/blocked calls) and we were disconnected before i can ask him any pertinent information as to his location or vehicle information. Now its has been two weeks since i last heard from him and i am so distraught and and upset. I really don't know what to do. The car loan is in both my fiance and my name. I have been making payments since November. All i have now is the geogia dealership bill of sale (which has two numbers listed on it which are both disconnected) and his former cell phone, fax and prepaid cell # (all disconnected). I dont know if there is anything i can do legally? I have been so naive and now when i need every dollar for my wedding and future... this happens! Any advice i can get would be really appreciated. :(:(:(

I'm assuming you gave him the check? Was it cashed? Where was it deposited? I would try to track down the money then the vehicle.

If you have the VIN you can get a Carfax on the vehicle for $30 (or free if you know someone with a account). This will tell you if the vehicle is registered or at a dealership and what state it is in. This should tell you if you got scammed or not. I think the DMV can also lookup this information for a small fee, the Police may also help. In my town they are very helpful with tracking scams like this.

Also, what happened to your friend that knows this guy? What does he say?

Bottom line it would be hard to do anything legally if you don't know who or where this guy is. The good news is you will never hand over money to someone without getting the item you are buying. The bad news.... you already know.

Contact the bank and the police ASAP.
No ones going to call you from the hospital and not tell you what hospital they are in!

Cons run on the victoms Greed! I like they way he got you to hand over the check and all the paperwork just to get a newer model....
