Hello. Yes, if it was your own insurance company covering your meds, and there is a reimburseable clause in the contract, then you must pay the insurance company back - - however, since a settlement is a "common fund" from which your daughter and the insurance company gets paid, you are entitled to a discount of 33 1/3 percent, which would be the amount you are entitled to for having "collected" the insurance company's money and refunding the same. So, for example, if the meds were $3,000.00, and your settlement included that amount, you'd only have to reimburse the insurance $2,000.00. But, you've got to let your insurance company know that is what you will be doing.
Now, insofar as settling the claim, you need to know how to write an effective "settlement demand letter." When you're ready for that, I post an example for you and instructions for you to follow. Are you okay enough to want to get into the "claim thing"? It's not easy, and it's really going to require a lot of detailed thinking; so, when you think you're ready, I'll be right here for you.
Yeah, go ahead and show her my post. She'll plotz when she reads about my Prom Night. The hotel "thing" has been "done to death." How many Proms have you heard of that were in the middle of a Wild Animal Park, with Giraffes, Rhinos, and Lions, all around? With a lake, no less? What a night !!
