I have lived in the same apartment for 2 years since moving to Georgia. My initial lease was for 1 year, and since then, I have renewed the lease 2 times for 6 month intervals. Ever since I moved in, my heating and air conditioning has not worked. The first time, I called the office, and they sent someone up to fix it. The repair lasted for two weeks. So, I called them again with the same problem, almost every two weeks. They would come up and re-charge the AC unit and again, it would last a few weeks before leaking out again. More often than not, the AC/HEAT would break on a saturday evening, or sunday, and they told me they had noone who could fix it until monday. Meanwhile, I had to live in an apartment that was well over 100 degrees (or sub 65 in winter). The heat kept me from sleeping, because I would soak the bed with sweat. I spent several nights sleeping in my car, because the heat was unbearable. I am sick and tired of calling them every two weeks to have it repaired.
I found a new place to live, and can be moved out by the end of the month. However, Since the AC/HEAT still does not work, I did not pay this months rent on time, and still have not paid it 10 days later. (This is the first time I have ever been late on rent) They sent me a notice saying I owe them the rent money, plus $100 late fee, plus a $100 dispossessory fee, and that if not paid in 3 days, they would take me to court. My last lease expired in November, I resigned for a 6 month lease in December, however, they sent the entire lease form back to me, so they have absolutely no record of it. (they keep calling me asking for me to bring it down so they can make a copy). I thought maybe I could just let them sue me, and countersue them because the heat/ac does not work. (something I would like to avoid) Or should I just suck it up, pay this months rent (with late fees) and tell them this is my last month? Should I pay to have a heating an air conditioning specialist come out to document the problem, and the fact that it is indeed broken? I do not have records from every time I called, however, I do have one reciept from the apartment complex stating that the AC unit was leaking, and that it was fixed. (from about 1 year ago)
