PayPal Legal Issue

I have a question for everyone out there about how i should proceed. About 2 years ago I sold my laptop on ebay. I used paypal for the transaction. After the buyer recieved the laptop he noticed the laptops cd rom drive was broken in shipping. I had told him this was final sale as I needed the money for bills. The laptop was also still under warrenty and I offered 200 dollars for the trouble. He refused and filed a dispute with paypal. He sent the laptop back before paypal could make a descision. I called paypal and was told to refuse shipping or my account would automaticly be charged the money. I did so about 2 months later he filed with his credit card company which took back the money from paypal and he did not sent the laptop back. I have been contacting paypal and the seller about this frequently over the passed couple years and never getting a response. I was contacted by a collection agency and they were appauled by the situation and have never called again. I would really like to be able to use the paypal service again but they will not unlock the account and I feel they are responsable for not correcting the issue with the credit card company. They said they contacted them about it but i find that hard to believe. They are telling me the credit card company said since i refused shippment once he didnt have to send it again. I have contacted ebay the parent company about the matter to try to avoid bringing this to the legal level. What should i do?

Sorry to say, but you have a very typical story.

It's happened thousands od times.

I contacted paypal again today so im guessing im probably going to be hearing from a collection agency again. I am hoping ebay will be willing to help in the matter as i sent an email to them as well. Is there anything i can do from a legal stand point? I really dont think paypal should allow a credit card company to take the money from them cause there basicly a bank. Its alot more fair for them to decided on this sort of thing because both parties get the oppertunity to plead there case where a credit card company refuses to talk to the seller.

Paypal didn't have a choice. When the customer filed with his credit card company, paypal HAD to refund the money, therefore, they took the money back from you.

yes i know. but basicly they told me the credit card companies reasoning was thay i refused shipment so he didnt have to send it back again. I refused shipment opon paypals request which makes them responsable. It happens to people every day. Paypal does not have a system in place to help in this matter this user agreed to there TOS and part of a chargeback is that the item needs to be returned to the seller. I have filed my case with the better business bureau, the attorney generals of california and nebraka (where paypal offices are located) and the FTC. I hope to hear back from them soon.
