What is the name of your state (only U.S. law)? Virginia

Several months ago, I gave notice to a former employer I was leaving, worked my 2 weeks and moved on. I had direct deposit with them, a month went by they kept depositing pay, I called asked them to stop of course. Now they are asking for a refund, what are my rights? No choices, just mail them the check, or forget it?What is the name of your state (only U.S. law)?

You have the right to be paid for hours you have actually worked. Beyond this, you should have sent the money back immediately, before you got attached to it and decided to spend it. You do not have a right to keep it now. They have a right to get it back by any means they want to use.

And why would you possibly think you have the "right" to keep it? If you had overpaid one of your bills, wouldn't you want the money back?

Write them a check today for the net overpayment. Do the right thing (credit: Spike Lee).
