Pediatrician threatens suit

My daughter took our grand daughter to the pediatrician on Friday for her booster shots. The nurse that gave them to her claimed that she was stuck with a needle. Neither my daughter or son in-law witnessed it even though they were both right there. She told them they had to take her to a lab in the next 48 hours to have her tested for HIV. My son in-law questioned this request and the nurse said they would suit them if they didn't because the law stated that they had to get her tested. My grand daughter is 4 years old and is very fearful of needles.
Subjectively; my daughter and son in-law have tattoos (lots of them) even though he is a professional designer and has great insurance coverage we all believe this nurse to be prejudice because of their appearance.

My question is; is there a law that makes them put my grand daughter through the pain and trauma of a blood test because the nurse (supposedly) stuck herself with the needle? Is there grounds for a law suit?What is the name of your state (only U.S. law)?

The nurse sticking herself with the needle is something she needs to handle with her employer. It is not the fault of the patient or the parents and has nothing to do with them at all.
 
scuse me.....I was stuck on a dirty needle at work and needed also to be tested for HIV for one year. That is standard practice. It is also standard to check the person whose blood you are contaminated with so you havea baseline to go on. Who cares if the parents have tattoo's. This person stuck herself. Get over it.

I would guess it depends on the individual facility's policy. We also require a blood test from the patient and nurse. Then the surse will have follow up testing at 6 months and a year.

HIV testing can be done via OraQuick/OraSure methods which does not require blood samples but rather obtaining a few cells from the lining of the mouth.
