An employee got, and took care of, a DUI about a year ago. Yet she apparently was stopped (not once, but) twice while her license was suspended. Her lawyer who is handling this, called and said they was her to go to jail for 30 days (maybe 17 day with probation?).

Not that it makes any difference, but she is young (23), employeed, newly pregnant, nice and hardly your hardened criminal (i.e. never been to jail before).

Question: Is this penalty correct?

Thanks in advance

I see by the number of great replies to this and other post that this forum has gone the ways of the dot coms.

The old saying "you get what you pay for" is certainly applicable to the law industry. Thus, Freeadvice.com is truly an oxymoron.

Yet all is not lost -- this board does have some entertainment value.

My response:

It's because you've posted to the wrong board, Mr. Impatient.

This is the "Moving & Other Violations" law board. While your employee was in fact driving, she moved well beyond the realm of getting a "speeding ticket" (for example). She moved into the "Felony" crime arena, and therefore, your post should be in the "Criminal - Drunk Driving" law board.

We're glad you found this board "entertaining!

You're brilliant IAAL! I even gave you the 'light bulb' icon.

But if you look in the "Criminal - Drunk Driving" law board, you will see the same post made on May 4th, 2001. The reply count on that board is zero / 0.

So IAAL, my statements still stand. After posting, and reading other discussion threads, I have found what appears to be a useful forum, useless. Again, I'm a "newbie" / "junior member" (what is that about) to this forum, so this is just my opinion.

For others benefit, my employee's parents "bit a $2000 bullet" and hired a lawyer. Plus I have found her a lawyer for a second opinion. It appears this hardened criminal is going to jail for the suspended license charges. The jail time is between 17 and 30 days. Luckily I am understanding, but I wonder if the 17-30 days is meant to be just long enough for others to lose their jobs?

At least if she is in jail for 17 days she won't worry about getting caught driving without a licence a third time.

Actually, she has her license back. She got it back after the DUI trouble was taken care of.
