Performance Review Withheld

I have been working at this job for about 9 months. After 6 months, all employees receive a review and a pay raise, to be no less than 3%.

On the payday immediately succeeding my 6 month anniversary, I was not given a paycheck when they were passed out, with no explanation, and was a little freaked out for several hours before I was informed that my supervisor was holding it until he could give me my review. He played solitaire all day and then something 'came up' in the last 15 minutes of the workday, and he 'couldn't get to it'. He tossed my check at me and told me we'd go over my review on Monday.
I was only given a 25¢ an hour raise, which is less than 3%. I have still not gotten my review or any explanation why my raise was so small, even after asking for it repeatedly.
I have always shown up to work on time, and only called in sick when I had pneumonia, for which I got a doctor's note and informed my supervisor on Monday that I would be out for the whole week. I do my job, I have never been disciplined.
I guess that's pretty irrelevant, I just want to know if I have any kind of legal action I can take if he still refuses to give me my review. I have spoken to my HR Director and she just told me to keep asking him.
I don't know if this is relevant, but I also know that my supervisor has already completed the written review for a coworker that was hired after me, who has only been there for 3 months.
Also, I know that another employee never received her 2 or 3 year review from our supervisor.
Anyone have any advice?
