This is a tricky one!
My ex partner has custody of our 5yr old daughter. He won this because he lied and accused me of physical abuse to our daughter- which is untrue- all the allegations have come up as unsubstanciated.

I didn't have a lawyer at this stage, I had no money and no job- so I was granted LEgal Aid. I also went onto a government payment (Centrelink- New Start Allowance).

This case has been ongoing for three years now, and six months into the case I met someone, and we soon after began living together.

I did not tell Legal Aid because I was certain I would lose Legal Aid and I did not tell the government that I was living with someone else because we needed the money. His inome is not enough to support us and my case.

Our trial is up in 10 weeks time and I am frightened that I will be caught out lying about our living arrangements, and the effect this living arragement will have on my chances to get my daughter back into my care.

One of the main reasons that we lied about this fact was because my ex has accused my new partner of physical assult to him (which my ex actually started- but my new partner finished so to speak) and so we had to go through a family report. The fam,ily report guy said that he and I should take our relationship slowly and not live together otherwise the court may assume that our daughter is better off with my ex based on the fact that he has not repartnered, and he said it would be more of an adjustemtn for our daughter to move back with me of I were living with someone.

My daughter knows and has come to love my new partner dearly.

Where do I stand, what should I do? and what will happen if my ex has a private detective checking us out? (It should be known that I have a DV order on my ex and the order said that he is not to have anyone else stalking us either- would this include a P.I?)

Should I admit to us living together all along and risk being imprisoned, or shoulod I admit that we are living together now, or should I just keep on keeping on?

Thank you for putting up with me. My intensions have been good from the start- I know I lied- now I'm scared that UI'll lose my daughter because of it!

Please help.
