person I am suing died two weeks ago what happens now

I was taking a friend to court over a motor cycle he bought from me and did not pay for!! I filed a motion for discovery and it was granted. the next date is set up for jan 15. But this person has died earlier this month. will this be tied up in probate? and will I still be able to get my motorcycle back?
