Ok My real name and pictures of myself and my home have been posted on a public message board.They doctored the photo to well**************..its not pretty.Contacting the webmaster does no good.Then they are also posting diary entries and putting me down pretty bad.Not sure how else to handle it.I'd gone to the city police but to no avail.What can i do?I tried not going to the site and not posting but this behavior continues on and on.Any advice would be apreciated.Not the richest person but need this to stop.

Also as a result i believe a person called the cps to investigate into my home.

They posted my real name on the website as well as my screen name there.They then posted old diary entries and posted a picture of me that the doctored up.They have drove by my home taking pictures and posting them on the site.They are making wild accusations and posting private information on the web site.I email the web master with no results and taking printed copies to the local law enforcement does nothing.What can i do?I just want it to stop and the information removed.But this does not seem as it will be that easy.They have gone on to insult my wife and two young children.1 is 5 the other 3****************************...

They are saying that i'm lazy and can't work yet i'm disabled.Being on disabillity means i'm also not the richest person so they insult me on this.My wife had been untrue in the past and they bring it up.One even a while back (post was removed) made a solisitation towards my daughter saying in a few years they will try for a blow job.The photo the doctored was on a profile a long time ago.The diaries are really old and was from a time when i was confused.In it at the time i thought i might have been transgendered so they are attacking me on those grounds so i'm guessing it could also be considered hate crime.

So far, other than the possibility of illegally gaining your diary, nothing I can see.

maybe. it would depend on a lot more than you should ever post here.

Now, I'm sorry to hear what you are experiencing but honestly, I don't see much you can do.

There are a few things that may be actioanable but you would need to speak with an attorney locally. Do youhave any legal aid groups. Any law schools? They often provide probono work.

unfortunately the perfect defense to libel and/or slander is that what is being said is the truth. With exception to the item about your child, which by the way is inexcusable and leads me to believe that you are in fact dealing with hateful, despicable pigs, everything that they are saying seems to be truthful. Or truthful in their perception.

My suggestion is that you hire an attorney to write a cease and desist letter to them. It won't really mean much because again, they are not breaking any law that I can see, however, for many people, simply receiving such a letter is enough to make them back off.

Sorry if i sound mean but this isn't new.Its been on going and has been for almost a year now.I'm just so upset and frustrated that i have no idea what to do or where to turn.I'm not sure about legal aid and such.I live in a small town and have never had any legal problems before.So never needed a layer before now.I'm just not sure what if anything i can do.These individuals would not be swayed by a letter i'm afraid.

which one of the items in the bill you posted do you claim that they are violating?? (by the way, a bill is not a law, although this one may have passed, I am too lazy to look it up to find out.)

oh, okay, well then by all means don't try that. Oh, and don't notice either that one of the conditions for the computer crime that you posted the BILL on, happens to be continuance of harrassment AFTER a cease and desist letter.

I did not say i wasn't willing to try it but to do it i would need to know who i'm writing to.They know who i am not the other way around.Webmaster will only turn over ips if there is a suit being brought forth.I'm not complaining i'm looking for options on what to do.I'd tried the webmaster aproach.I've tried local law enforcement.Just looking for other options.Are you always this cynical or is it just me?

If you believe you are being defamed on this website, take all of the information from that site and take it to court.

OSPs and ISPs avoid liability in any defamation lawsuit if they remove offending material from a website when notified it exists. However, due to lack of prosecution against them for not complying with requests, due to the increase in the number of requests, and to preserve the "free speech" atmosphere of the Internet (among many other reasons), many are now refusing to remove material deemed offensive or defamatory or infringing without a court order (search warrant, subpoena) telling them they must remove it.

In other words, you must PROVE to a judge that the material is, in fact, defamatory, and then the judge will issue a subpoena, and then the material will be removed.

You should be prepared to show how your reputation has been damaged by the content on the website. Just because what is said is false, causes harm or embarassment, or ridicules you, if it does not damage your personal or professional reputation, you probably do not have enough for a defamation suit - or a subpoena.

Truth and opinion are both defenses to any defamation suit.

You can go over all that you have with an attorney before going to court, to see what he/she thinks. Check out free legal clinics or law schools in the area to cut costs.

First of all. As another posted pointed out, you must show the info is false and you have been damaged. Even if you feel Privacy was invaded, it is not an easy win. Unfortunatly, you have to have some Bucks to hire a Lawyer! There is no way around that. lawyers want to make money, they are not concerned with Charity cases! also, this person must have had a reason for doing this?? There are two sides to every story! if you aren't willing to break out the Checkbook and hire a Lawyer. Then just don't read the material.

So you don't have any idea who the person is who has your old diaries and photos, knows about your wife's infidelity, knows about your disability and work status, knows where you live, and has enough of a grudge to watse his or her time posting nastygrams and doctored pictures of you on the internet?

That's a little hard to believe.
