Ok, 12/13/2000 I fell off a ladder at my construction job in Rochelle, NY. It was about 15 feet and there was a 3ft by 3ft trech all the way around the foundation as it had not been backfilled. My right ankle rolled on the side of the trench and snapped. The field supervisor of the Co. that my employer subcontracted for drove me to the hospital. I had to have 3 screws in my ankle and i also had an external fixator installed for six months. I had 2 follow up surgeries to realigh, then to implant a bone stimulator. Doctor said I might need to have it Fused at one point.

I now walk with a limp, I have limited rotation (left to right) and cannot move it up and down that much. It is discolored and scarred. I have a case going because apparently there is a law in NY that before any roof work can be done, the foundation should be backfilled.

Anyone have any idea how much i could get out of this? or if i have a chance of winning?

Well, no, there isn't. What there is though is absolute liability on landowners and contractors for injuries sustained for workers "at heights" and liability for the same folks for failing to provide a safe workplace (Labor Law ss. 240, 241).

Anyone have any idea how much i could get out of this? or if i have a chance of winning?
Being that this accident involves an absolute liability statute, there's a good chance the defendant's carrier will want to settle, but as to an actual amount, we could only speculate. Bad ankle in that county can range from $25k on up.
