What is the name of your state? Michigan

I am in the process of collecting an amount of money from a suit that I am involved in for a condition that arose from taking a certain drug. My question is: Because this is a person injury case, is that money mine alone or does my husband have rights to that money as well? Thank you for your time.

Is he a party to the law suit? Are you going to put it in a joint account? Are you planning on getting a divorce is why you don't want him to have it?

No divorce or anything like that. He is not a party in the suit and I was planning on investing the money. However, he thinks that I should give him a certain amount of money to do with as he pleases because he says that it is part his money because we are married.

Hello gtcpl2, I am astonished by the lack of amour of your husband and to think what you have been through just to have that money. I think you need to consult a lawyer before giving your husband a share of your claimed money.

Also, please stick with Social Security law. You don't know what you're talking about. Of course she'll talk to her attorney!

However, in response, either your husband didn't want to be a party plaintiff in your lawsuit (i.e., the cause of action is "Loss of Consortium") or your attorney committed malpractice by not including him as a plaintiff.

Suffice it to say, your husband is not entitled to any of your money - - that's why it's called "personal" injury. It's an injury "personal" to you. Any money received by way of settlement or judgment is separate property. So, deposit the money into a separate account and tell your husband to bug off.
