What is the name of your state? - California

Hello. We have a staff member that always leaves early or comes in late due to family or personal medical appointments. There is nothing in the employee handbook on this particular issue. We in the office have just been curious about what the real rules are. Is it supposed to be taken against sick time or vacation or nothing if it's not in the handbook?

Your employer's handbook is by and large irrelevant. I don't know whether this employee is chronically absent/tardy and your employer has elected just to look the other way OR this employee qualifies for intermittent or reduced schedule leave under the federal FMLA or any "leave law" California has. If the latter, then it's no one's business other than the employee involved and company management. You and your coworkers aren't entitled to an explanation.

Whether the absence/FMLA time is charged against the employee's sick or vacation time is a matter of each company's policy/practice.
