personal possession repo rights

When a car is repossessed what are the consumers rights as far as personnel possessions that are the car and am I required to pay any fee in New York/New Jersey (the car is held in New Jersey-I live in New York) to get my possessions back? I am letting the car go back to the dealer, as unfortunately I can no longer maintain payments and insurance.

They are your possessions and you have every right to them. They have NO right to charge you to retrieve your personal possessions and in the case of a normal repo, they have to allow you to get your things.

You DO know that this volutary repo doesn't get you off the hook, right ?? They will sell the car at auction and then they'll come after you for the difference between what you owe on it and what they sell it for, which will be nowhere near what you owed on it. Then they'll tack on all kinds of lovely fees for their trouble in selling it !

Yep. Anytime you are considering a 'voluntary repo' it is ALWAYS better for you to sell it yourself, even if at a loss, then to allow them to auction it off for you (often for as little as 10% of its value).

In anycase, if your "letting the car go back to the dealer", why did you leave personal belongings in the car. Don't you really mean.... they came and repo'd my car in the middle of the night, without me knowing about it, but I am not going to try to get it back?? That is NOT a 'voluntary repo'.

As for recovering your property, you need to contact the repo company and the lender. The repo company is only operating as an agent of the lender... and the lender has the final responsibility for any personal property in the vehicle at the time of recovery.
