We agreed upon a sale price with a person and put it in writing. We documented a $1,000 down payment was received. The due date for the remaining money was 2/11. Multiple due dates went and passed then on 2/24 we were notified they did not want the trailer and wanted the down payment back.

I say no, we passed up other opportunities to sell the trailer because we had their commitment to buy.

Am I off base?

My response:

They bought a trailer. Turn it around on them and tell them you'll be happy to sue them in Small Claims court to force them into paying the balance owed.

As adults, we can't just enter into contracts, and then say, "King's X", or "Time Out", or have "crossed fingers" behind our backs. Life just doesn't work that way. You relied on them, to your detriment, to complete the contract. As such, you are entitled to the benefit of the contract - - that is, the money.

If they want to sue you, tell them, "Go ahead, and YOU explain your position to the judge."
