When a lawyer discovers that a preponderance of the evidence goes against his case and he continues on a course of litigation, what can or should be done. The issue is this. Our commercial landlord is suing us for eviction. It has been shown to landlords attorney by our attorney and by witnesses for us, they are tenants in this shopping center, that the landlord has no case and that his assertions about us may be fraudulent. Is the landlord and attorney trying to run up our attorney fees. What is this behavior considered in that they now know that their assertions do not hold water and they in all likelyhood will not prevail and they refuse to dismiss the suit.
