I'm a little confused as to whether it is legal for a landlord to charge a monthly pet fee either instead of or in addition to a pet deposit in Delaware. Half of the places I've checked out to rent have said that this is illegal, but there are still several doing it. I read the landlord/tennant code, but all it says is that all fees must either be for a service provided or must be returned. Anyone know for sure?

Section 5514 (i) (2)

No landlord may require a pet deposit in excess of 1 month's rent regardless of the duration of the rental agreement.

The pet deposit is usually in addition to a security deposit.
