My husband has filed for a divorce petition is Texas which I have contested. Hearing was set 3/20/01 which I did not attend. I just sent a long affidavit to the Court my grounds for contesting the divorce and the reason for not attending. As I am a recipient of unemployment benefits, I cannot leave and am required to look for a job. I have asked the court to amend petition of divorce to annulment and asked for plea for justice.
I would have thought for sure that I would be in default for non-appearance but instead a pre-trial hearing was set for 4/24/01. My husband responded and filed for motion to strike all allegations which he said are hearsay and irrelevant even his previous marriage to another woman.I really cannot appear on this hearing for financial reason.
Questions:
1. What can I expect if I donot attend the hearing?
2. What would happen if I do appear?
3. Can my husband sue for anything (if he wants to get even
4. I sent photos and a copy of marriage certificate from my husband's previous marriage in the PHIL. Why was my exhibit considered a hearsay?
5. How can he deny the pictures and the marriage certificate?
6. Can my husband sue me for support since he claims he has no job at the time of our separation and I had.
7. What can be done to prove my evidence are not hearsay?
8. Why did the court not declared me in default the first time?
9. Why is this hearing set up in a civil court?
