What is the name of your state? Minnesota

Hello, does anyone know where I can find the petition for third party custody change referenced in 257C? We are the aunt and uncle, the kids have been living with us since May, plus many times before due to the parents loosing them because of drugs. 257C states what should be in the petition but not where to find it. Is it acceptable to just type up a petition with the necessary information??

when you say that the parents have lost the kids many times before, it sounds like they're in the system. The kids' social worker should be able to help you with this.

The kids were returned to the mom, so they are not in the system anymore. She left them with the day care lady a little over a year ago, and within the last couple months wants them back. There is a social worker involved but she doesn't have enough to file a CHIPS petition.

I have actually already found 257C, and where it says what needs to be in the petition. We just had court on Monday, we had used the paperwork on this link: http://www.mncourts.gov/default.aspx?page=513&item=55&itemType=packetDetails

We had met with a lawyer who said we should change the title on the paperwork to say:
"Affidavit in Support of Motion for Custody per 257C." and "Notice of Motion and Motion for Custody per 257C."

Apparently that was not good enough for the judge, he said that we need a petition to change custody. I have had no luck finding the paperwork for that. All of what is required in the petition according to 257C, was in our original paperwork. Does anyone know if simply changing the title on the paperwork is what I need to do?? Or should I write up my own paperwork?
I'm lost here on this... thanks for any advice!

I just spoke with an attorney who said that I could type up my own petition, label it "Petition for Third Party Custody Change (per 257C)" and type up all of the required questions that appear in 257C along with the answers.
Is there anything that anyone can think of that may not work out with doing this, or any other suggestions?
