petition name change again?

I have a 2 1/2 year old child who has bios last name, some time ago I petitioned the courts to change childs name to my last name as the bio hadnt seen child since birth. Bios mom got a lawyer for bio and contested the petition, judge denied the petition due to the fact that he stated that even though the bio has not made any attempts to see the child in the past he believes that since he contested the petition and stated that he wants to see the child now that he was denying the petition. My question from KS is that it has been some time now and he still has made no attempts to contact myself or the child, so I want to know if this is something that I can petition again, or is it set in stone just because the judge already made the ruling. Thank you

If he clearly stated that he wants to see the child, the judge denied it based on that statement and he has made no attempts to do so, then you probably can petition again and have a better chance at success.

However, would you be ok if this pushes him to petition for and get regular visitation? Most mother would freak at suddening having to give up their child to a stranger for overnight visitation..

I already have a petition for custody and visitation. I have sole and residential custody and he has supervised visitation. Which he has never taken advantage of. I know that he doesn't want to see my child, so I am not concerned about that I just didn't know if I could petition again. I have recently married the man that has taken care of my child since 4 months old and whom my child reffers to and thinks is her Father. Thank you for your response.
