I would like to petition a video game manufacturer to offer commercially available replacement joysticks for thier controllers. I would like to place this petition on the net(ie. Yahoo.com). Would using the manufacturers name without their permitionget me in trouble? Would mentioning in the petition that the joysticks are not "Robust" and that I feel that they wear out too quickly be cause for litigation against myself?

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

YES AND YES.

To your first question, possible trademark infringement issues and possible intereference with their potential customers.

As to your second question, it depends on how you put it. If it is opinion and in a bulletin board, maybe not. The problem lies if this opinion looks like fact and many people see it.

Why put yourself through that?

Dear Sir, Thank you for the information.
I am doing this in part because I would like to bring to their attention that this is a more widespread problem than they might realize; and because I feel that what they are doing is wrong. Their equipment is directed toward children. I believe their equipment should be robust enough to last at least 1 year before failing. I would even be happy to purchase the replacement parts, but they will not allow that. They want us to purchase the entire controller again for 25 to 30 bucks each. Besides I don't have anything anyhow, and daddy always said you couldn't get blood from a turnip. Thanks again, any help is appreciated.
