What is the name of your state? Texas. I would truly appreciate any information anyone has for me. I am a 33 yr. old woman. I've never been arrested, or done anything illegal (other than speeding)and I've never done illegal drugs. I went to my ob/gyn and received a prescription for birth control and he was supposed to give me a presc. for prozac. He gave me my samples, and two prescriptions, but one was blank (total truth). When I got back to work I realized he forgot the prozac presc. He's at least 80 years old, and I figured he forgot. I thought that since I knew it was in my chart, and it wasn't a narcotic, I'd just write it myself. Stupid I know, but I have no excuse. I thought that if the pharmacy wasn't sure about it they would call the Dr.'s office, and they would confirm it. Well, they did call, but the Dr.'s office didn't have an official order, so they called me. I went to see them and explained what I had done, and apologized. They said no big deal, hugged me (crying) and told me not to worry about it. Now I get a call from a police officer who says the pharmacy reported it, and now they are about to get a warrant for me. I asked her what to do, and she said that I could come in Friday and she would have a low bond for me, and said it was a class "D"??? misdemeanor. Said I wouldn't go to jail. Did I hear her wrong? Is there such a thing? I am absolutely terrified. What will happen to me? Please don't hate me for being stupid.

Don't be afraid. I don't think you would go to jail for that. Just explain to the police or the judge (if you go to court) what happened and let your doctor confirm that he gave you that perscription. It is not a big problem really, so don't be afraid.

CHAPTER 483. DANGEROUS DRUGS

§ 483.045. FORGING OR ALTERING PRESCRIPTION. (a) A
person commits an offense if the person:
(1) forges a prescription or increases the prescribed
quantity of a dangerous drug in a prescription;
(2) issues a prescription bearing a forged or
fictitious signature;
(3) obtains or attempts to obtain a dangerous drug by
using a forged, fictitious, or altered prescription;
(4) obtains or attempts to obtain a dangerous drug by
means of a fictitious or fraudulent telephone call; or
(5) possesses a dangerous drug obtained by a forged,
fictitious, or altered prescription or by means of a fictitious or
fraudulent telephone call.
(b) An offense under this section is a Class B misdemeanor
unless it is shown on the trial of the defendant that the defendant
has previously been convicted of an offense under this chapter, in
which event the offense is a Class A misdemeanor.

Class B Misdemeanor carries the penalty of up to 180 days in jail and/or $2000 fine.

Don't worry, you won't go to jail. I commited Rx fraud, 3rd degree felony and will be getting probation with possible fines and community service. You will most likely get something like that but MUCH less than me.

update

I wanted to let you know that I talked to my husband, and he was very understanding/helpful. We agree that I need to find a lawyer to protect my livelihood. I know I should have thought about that before I did such a stupid, stupid thing. I hope I can find someone who can help me, someone compassionate. Thanks again for your advice before.

If you want someone compassionate go to a priest/preacher/shaman/rabbi. If you want good legal advice, go to an expert lawyer who will tell you the truth.

update

Just wanted to leave one small ray of light on this forum. The charge has been dropped. After investigating and interviewing further, they found that I was indeed supposed to have this prescription. Valuable lesson. Good luck to everyone else here.

I'm happy for ya! You didn't deserve legal trouble anyways.

Thanks girl! I've watched your posts with great interest and have felt so sorry that you received the grief that you did here on top of the real life trouble that you have had to deal with. I believe that there are a few, maybe many, members here who are either jaded, or bored to the point that they forget about the many unlucky(stupid in their opinions) people who, out of human desperation think they can receive some sort of help here. I myself, worked at Parkland hospital for many years in Dallas and have seen a lot of bad things, but I always strived to help the less fortunate. I understand how hard it can be to feel compassion for people, after being subjected to all of the evils, and inequities of humanity day in and day out; but to be so cruel to someone you don't know, and could never know fully, I will never comprehend. Tyson, thanks and good luck! SeniorJudge, Thank you for taking the time and giving me honesty and a semblance of human decency! Thanks also to Sadness. Lastly, I would like to remind everyone of the principles that the founders of this country believed in. Liberty, and Justice for ALL!

I'm glad you got away from Parkland. That hospital is pure misery for the employees and the patient. They should blow it up!!! I'm only kidding....well not really. Did you get to read all of my threads before I deleted them?
