petty question about legal fees

A paternity test was ordered for my child, myself and alleged father.
Father and I are in different states. My attorney told me to call this
lab and that they would send me the test kit in the mail. THis sounded
ridiculous to me as I knew it couldn't work that way. I called the lab
and they said my attorney is wrong and that I needed to go into the
lab to get the samples taken since there is a strict chain of custody
with legal paternity tests.
Anyway, my attorney is charging me for the email she sent me in
which she told me to call the lab and they would send me a kit for
the samples. Since she gave me incorrect info. should I bring it to
the attention of her superior? She is a brand new attorney and
has really messed up my case thus far. I have already had to call
her superior once and was refunded over $600.

If you have already been given a refund for your atty's incorrect advice, why are you still using her?
It's worth a shot but you need to get rid of her.

I would have to agree with the other poster, if they are screwing up that badly why are you still using her??? Keep in mind this is the woman that you are partially entrusting your childs life with! But your lawyer was correct about procedures for non-legal tests so she was partially correct, but consider do you only want partially correct info from your lawyer?? I wouldn't. When you speak to the supervisor perhaps you should ask about having a different lawyer in the firm handle your case, or else once the refund is handled perhaps you should start lawyer shopping again.
 
I talked to her superior and told him I wanted to change attorneys
within the firm. He said everyone else there charges twice as much
as she does. He said he'd monitor the case more closely if I stuck
with her. I decided I'd stick with her because I didn't think it was
possible to mess things up much more than she already had!
Hard for me to believe that this chick is actually a lawyer.
It took her FOUR months from the time she filed for me to request
a paternity test. She kept asking me for months, have we requested
a paternity test? I kept telling her no over and over (plus I had to
pay to tell her that!!)
She repeatedly has told me she was going to do something such
as respond to fathers attorney and never does what she says she is.
Maybe it's her way of trying to get more money out of me. If she
doesn't do something, I have to call her and then she charges me
for her phone time!

I want advice on what to do about my attorney and I think I have
already gotten some good advice from some other posters. You
are not "having to read" my post. If it is not something that interests
you from the title then just don't read it. That's my advice to you.

Yes. Maybe it depends on the state but I can tell you there ARE companies out there that you can call and they will send you a test kit. You take it to the hospital with you and they draw the DNA from the placenta. The father has the DNA test done the way men always have it done. As long as he's cooperative, then you both know who the parents are and then when the Acknowledgement of Paternity form is presented, both sign it.
 
Well, something to consider...
The money you are spending every time she bills you for unnecessary calls and emails COULD be spent on a more reputable and competent attorney... if you are going to spend the money regardless, wouldn't you rather it be spent WISELY? Just my two cents....
