What is the name of your state? CA
resolved petty theft case, public defender said that it was her understanding that my grandson did not have to pay a fee to JCPenney of $250.00 for theft of shirt because they got the shirt back, but she said to check with legal advice to double check. Does he have to pay the JC Penny Company the $250.00 as noted in a letter from a recovery co. for JC Penny C0. as there was no loss?

CA permits a civil assessment to be sought by businesses that are victimized by thieves - even if the item is recovered. The fee is to compensate them for the cost of manpower to investigate, apprehend and prosecute the suspect, and then to re-stock the item (unless it has to be replaced).

However, I believe that the onus for collecting is entirely upon the business. They can take it to court or collections if their request is refused.
