Hi, I'm in Arizona. I have an issue! I hope I put this in the right forum.

Just recently my boss discovered on his phone bill, some online company had been charging $34.95 a month for like 3 or 4 months.

They called this company and yelled at them for an hour about it and the company said they WOULD refund the money. However, they produced a recorded audio tape of, they claim, MYSELF, actually authorizing and agreeing to accept these charges on my boss's phone bill! They had questions like "are you firstname lastname" and I say "yes". They say "are you autorized to make financial desicions on phonenumber firstname lastname?" and I say "yes I am". And on it goes. I can't see myself claiming these things.

Needless to say I then got in huge trouble, and they will take the full ammount for all charges out of my paycheck.
I, on the other hand, was extremely appauled at the situation because:

1. I NEVER claim to have financial responsibilities on my boss's account for anything! This is one of the questions they asked "me" on this recording and I apparently said I DO make decisions on their phone bill. In retrospect, I usually use this to get solicitors OFF the phone. By saying I am not the guy to talk to, bye, click. But here I'm supposedly saying I rule the place!

2. I NEVER tell solicitors to go ahead and start services on their account and bill them! That's utterly absurd! But still, this recording has me agreeing to start services. Or rather, start a 15day trial and THEN start charging the phone bill.

My first thought, of course, is that the recorded message is fraud. Perhaps someone did ask questions, and then those questions were changed in the recording? I just can't see myself claiming financial authority on their account, and then accepting to be charged. It's not something I would do. Ever.

So my question is multifaceted.

1. Is it legal to even HAVE this recorded conversation on the phone? It is NOT recorded that I aggree to BE recorded. And since this is between two different states, how does the law pertain to this? Can they even USE this recording to claim that I agreed to start services?

2. My boss thinks they are going to take out ALL charges from this company, out of my paycheck. I don't agree to this, when it's all obviously some type of fraud or whatever. I don't agree to pay THEIR phone bill because some random company charged it and then said I authorized it.
This being that the company even said they were going to REFUND. But it may take weeks. So my boss wants to take MY money until they get THEIR money back. Again, if I can't somehow "prove" that this phone recording is false (or is it even legal for them to have it?) then they will forcefully TAKE money out of my paycheck to pay their phone bill.

Does this sound weird to you? Am I responsible to pay my boss's phone bill because some company started charging them without their consent? How should I handle this phone recording? Should I even listen to it? Knowing that I think I would NEVER do the things I claim to be doing in the message. Is it right for my boss to just take my money for their phone bill and I am not supposed to fight it at all?

Please I could use some advice on this mess!
The name of the company on the phone bill is:
"LocalBiz Monthly Fee"
From "Local Biz USA.com"

Sound fishy? Could this be fraud? Is this really me on the phone in an exact recording, agreeing to start services? Can a company begin charging someones phone bill just because some random guy on the other end says they can? Can my boss forcefully take money out of my paycheck to pay their bills because they were neglectant to see many months of charges and didn't do anything about it? Why would I pay ALL the months? What action can I take to help myself in this? Rather then let everybody walk all over me.

Note that I haven't heard the message myself yet. I plan on recording it when I do. My boss is MAKING me call them and have them play the message to me so I can hear it.

Help? Thanks a ton. Sorry this is so long!

Nice site! Those complaints are exactly what happened.

I heard the recording, we have a copy. Like those people said, it was some lady, talking really fast and mubling. For what appeared to be like a listing thing I had validated our address and phone number, and for some reason, my birthday. Though they left out the year.
But for the "authorization" part, I don't remember hearing me give an answer. That is, I don't remember me actualy "agreeing" to anything.

So it is quite clear that this company uses tricky tactics to make it seem like whoever answers the phone agrees to buy. Whatever.

This I can accept, okay so a company tricked us. My boss yelled at them, supposedly we are getting a refund.

However, everybody is still looking at me funny like I "specifically", "purposefully", "did" this to them. Like I had planned it or something. On the recording I am basically mumbling myself in what sounds like impatience, like hang up already.

So now, am I guilty of something here? Should my boss take my money to pay their bill? Even for the months they didn't see it happened?
Like would it be fair if I paid just the first month, but not pay for the months they didn't see it? Should I have to pay at all? Because this company obviously just started billing their phone and I don't think the recording really justifies anything.
So is this MY fault or is it just fraud charges and doesn't have anything to do with me?
Sure you could say, I just should have hung up. But this is a business, and we try to keep current listings and perhaps that is what they claimed to be. Like a phone book listing maybe.

Note, in the recording, I did NOT agree to BE recorded. Any help? Any more thoughts?
