My ex may have recorded phone conversations
of phone sex between us and I am thinking he
may try to post this on the Internet at some point.

Is it legal for him to later post this
on the Internet with my name attached?

It would be "true" but I wonder if it would
violate any rules if I did not know for sure
that he
was recording the calls.

In Virginia, it is only necessary for one party to a phone conversation to know it is being recorded for it to be legal to record. So your ex could have recorded the conversations between you without your knowledge, and this would not have been illegal. However, should your ex decided to post the conversations between you on the Internet, he is violating privacy laws.

With privacy laws, truth is no defense. In "publishing" details of private matters, your ex can make an accurate and truthful representation of all that was said during the phone conversations but still be found liable for damages, if you are identified or identifiable in his postings.
